Stocks Back Off 2009 Highs

Stocks jumped between negative and positive territory on Tuesday before eventually ending mostly lower. The Dow Jones Industrial Average retreated one day after reaching a one year record. Investors chose to take a step back ahead of the first big wave of earnings reports from major market movers. Investors are hoping that the earnings reports will be positive and reiterate that the economy has truly made a turn for the best. Mixed results from Johnson and Johnson (JNJ) provided investors with no motivation to push stocks higher during the session. Financial shares took a hit after analyst Meredith Whitney lowered her rating on Goldman Sachs Group Inc. (GS) following a period of steep gains. Health care shares were also hurt by the Senate Finance Committee's approval of a health-care reform bill. U.S. light crude oil for November delivery rose 88 cents to $74.15 a barrel on the New York Mercantile Exchange. Treasury prices rallied, lowering the yield on the 10-year note to 3.32% from 3.30%. The dollar fell versus the euro and the yen.

Word on the Street

Cisco (CSCO) is back in the mergers and acquisitions game. The company just scooped up Tandberg ASA a couple of weeks ago and now the company has acquired Starent Networks Corp. for $2.9 billion.

Johnson & Johnson (JNJ) may have missed sales expectations, but the company managed to eke out a 1.1% increase in third-quarter profits. The latest report from JNJ provides a reminder of why other drugmakers want to be more like the industry giant.

The Supreme Court is cutting a former Enron executive some slack. The highest court in the land has agreed to hear an appeal by Jeffrey K. Skilling. Good luck with that since the lower courts have upheld 19 of his convictions.

After months of fighting and slanderous comments, Bank of America (BAC) has agreed to hand over legal documents related to its acquisition of Merrill Lynch. The documents will apparently reveal the legal advice that BofA received in regards to the acquisition.

The Chief Executive of troubled lender CIT Group (CIT) is running to the nearest exit. Jeffrey M. Peek plans to retire at the end of the year. Some are taking this news as a sign that the company is definitely headed to bankruptcy court.

The Walt Disney Co. (DIS) is giving its stores a face lift under the supervision and skillful knife of Steve Jobs. While other retailers are cutting back, Disney is spending more money .

Domino's Pizza Inc. (DPZ) reported that its fiscal profits climbed 77 percent , but not as a result of selling more pizza and hot subs. The company's success during the third quarter can be attributed to its cost-cutting strategy.

AT&T (T) and Nokia (NOK) are looking to be on top of the lap top market in terms of price. The two companies are introducing the new Booklet 3G wireless netbook for only $299. Is this really a good deal ?

The Senate Finance Committee approved an $829 billion plan to overhaul US health care. The insurance industry has already responded and said that it cannot support this finance bill. It reminded some people why they hate insurance companies so much.
